Acceptance of the General Contracting Conditions and Access to the Website
Access, browsing, and use of materials, content, or services accessible through the Website implies the understanding and express and unreserved acceptance of all the terms of these General Contracting Conditions, which establish the rights and obligations of MASIÁ CISCAR, S.L. (hereinafter MASIÁ CISCAR) and the User for the acquisition of the products offered on the Website, having the same validity and effectiveness as any contract concluded in writing and signed.
Access to the Website does not require registration of Users. However, acquiring the products offered by MASIÁ CISCAR requires the User to send the information requested in the Purchase Registration Form, including personal data, and acceptance of these conditions before initiating the procedures to formalize the corresponding payment.
Object of the General Contracting Conditions and Access to the Website
These General Contracting Conditions regulate access, browsing and use of the Website, without prejudice to MASIÁ CISCAR reserving the right to modify the presentation, configuration and content thereof, as well as the conditions required for access and/or use. For the purposes of interpreting these Conditions of Use, we understand that a person becomes a user at the moment in which they accept the General Contracting Conditions and the Privacy Policy set out on the Website, it being sufficient for this purpose to visit it.

MASIÁ CISCAR is a company dedicated to the production and marketing of fruit and vegetable products. MASIÁ CISCAR makes this Website available to the User as a channel to offer its products for sale directly to the final consumer.

CREDIT AND DEBIT CARDS
The Secure Electronic Commerce system is based on the card Issuer (bank or savings bank) identifying the cardholder before authorizing payment over the Internet.
This security system is carried out by means of the Virtual POS-Point of Sale Terminal provided by the Redsys banking entity
The entire process is carried out under appropriate security measures, HTTPS-SSL security protocol, which ensures at all times the encryption of data to prevent unauthorized access and maintain the security of the transaction.
Your card details and password are protected by this security system from the moment the page and/or form is presented for their introduction.
Once the identification is completed, the Issuing Entity of the Virtual POS communicates to MASIÁ CISCAR that the purchase is being made by the cardholder and has been accepted, so that it can complete the process. If the identification has not been satisfactory, the Issuer communicates it to MASIÁ CISCAR so that it proceeds accordingly.
This window is outside the control of MASIÁ CISCAR, and its Issuer is responsible for any incident that may arise with it, and you should contact said entity if you find yourself in this situation.

Delivery Time
The order will be sent to the specified address.
Orders will not be served in Post Office Boxes.
The general delivery time is a maximum of 10 working days, excluding Saturdays, Sundays and holidays. MASIÁ CISCAR will not be responsible for delays caused by reasons beyond its management or force majeure, such as procedures and dispatches in postal offices or courier-parcel companies.
Shipping costs include transport and insurance. Dispatch and/or customs expenses at destination or other taxes (tariffs or others) that may be applicable are not included; the recipient will have to pay them at the destination in order to receive the merchandise. In exceptional situations, such as Pandemics, Strikes, natural disaster situations, or others that are not normally foreseeable, the indicated delivery times cannot be guaranteed.
In the case of direct collection at our MASIÁ CISCAR address, we will send you a notice by email when the order is prepared. To collect it, you must present the email and your ID will be required.
In the event that another person appears on your behalf, they must present their ID (or identification document) in addition to a copy of the confirmation email, and a copy of the ID of the holder of the purchase.
Shipping Costs and Delivery Times in the Canary Islands, Ceuta and Melilla

Guarantee and Resolution of Claims
Guarantee
Royal Legislative Decree 1/2007 grants goods of a durable nature a legal guarantee of 2 years from the date of purchase and/or delivery.
Therefore, MASIÁ CISCAR guarantees the integrity of said goods for two years from the date of receipt of the product.
Deficiencies caused by negligence, blows, improper use or manipulations, or wear or degradation due to exposure to natural agents such as light, sun, dust, humidity, water, mold, harmful substances and/or atmospheres, or any other agent or context that may be harmful to the materials of the product are not included.
For the purposes of the guarantee, the buyer will be responsible for the correct situation, exposure, manipulation, storage, transport, or any other manipulation of the products that are subsequent to the receipt of the purchase.
In those incidents that justify the use of the guarantee, the repair, replacement of the article, reduction or return will be chosen, in the legally established terms.
In the case of perishable products, if the product has arrived in poor condition, the customer will have 48 hours to request the return of the products without any penalty at their expense, attaching a photograph of their condition. This right of return is limited to a maximum of 48 hours from the delivery or collection of the purchase.

Dispute Resolution:
- MASIÁ CISCAR has as a way of resolving disputes direct negotiation with each buyer, for which it makes available the email poner dirección email ensuring that it will make the maximum effort to resolve the situation to the full satisfaction of the customer.
- Likewise, the customer is within their right and may go at any time if they so wish to the systems provided in the local and regional Public Administrations for the defense of consumers and users.
However, it is recommended to contact MASIÁ CISCAR first to reach an agreement in the security that it will be beneficial for both parties.
Withdrawal and Return of Orders
According to current regulations, the customer has the right to a period of 14 days to withdraw from the purchase without the need for justification, a period that begins to count from the delivery of the order. After this period, the purchase becomes firm and only the specified guarantee conditions will apply.
In case of withdrawal, the transport costs (postal, courier, parcel, or other means) of the product to be returned will be borne by the buyer.
The product must be unused and in perfect condition, complete including accessories, documentation and in the original packaging.
The product to be returned must be delivered to MASIÁ CISCAR within a period of less than one month, except for reasons of force majeure, from the date of exercising the right of withdrawal, so the buyer must make effective due diligence in expediting the shipment of the product to MASIÁ CISCAR.
Once the merchandise is received in our warehouses, and after checking its condition, the amount will be reimbursed in the terms established in Royal Legislative Decree 1/2007, according to the payment method made by the client.
The return costs will be the responsibility of the customer, as well as the customs expenses and local taxes and fees that are applied to the receipt of the product at the address of MASIÁ CISCAR, said expenses will be deducted from the refund amount.
If the return is caused by a poor condition of the product, with prior authorization from Masía Ciscar, a collection order will be given at your home without any cost to the customer.
Returns are not accepted after 48 hours from receipt of your order.

In this way, we will execute the collection order of your order and we will be able to carry out an exhaustive control of the return.
The refund of your money will be made within a maximum period of thirty days, although most refunds are made in ten days. Please include each and every one of the elements and packaging that have been supplied to you.
In any case, the parties refer to the provisions of art 103.c and 103.d of Law 3/2014, of March 27, which modifies the consolidated text of the General Law for the Defense of Consumers and Users and other complementary laws, approved by Royal Legislative Decree 1/2007, of November 16.
Exceptions to the Right of Withdrawal:

The right of withdrawal will not be applicable to contracts that refer to:
- The supply of goods made according to the specifications of the consumer and user or clearly personalized.
- The supply of goods that may deteriorate or expire rapidly.
Therefore, contracts for the supply of products made according to the specifications of the consumer and user or clearly personalized, or that, due to their nature, cannot be returned or may deteriorate or expire rapidly are excluded from the right of withdrawal.
